These terms of service outline the rules and regulations for the use of Subhmangalam's Website and orders.

A1: Subhmangalam is located at:

Asansol & Kolkata, A Freelance Group In-House Set-up.

A2: By accessing this website we assume you accept these terms of service in full. Do not continue to use Subhmangalam's website or order if you do not accept all of the terms of service stated on this page.

The following terminology applies to these Terms of Service, Privacy Statement and Disclaimer Notice, and any or all Agreements: "Client", "You" and "Your" refers to you, the person accessing this website and accepting the Organization's terms of service. "Subhmangalam", "Ourselves", "We", "Our" and "Us", refers to our Group/Company/Organization /Subhmangalam. "Party", "Parties", "Customer" or "Us", refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance, and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration or any other means, for the express purpose of meeting the Client's needs in respect of the provision of the Subhmangalam's stated services/products, in accordance with and subject to, prevailing law of India. Any use of the above terminology or other words in the singular, plural, capitalization, and/or he/she or they, are taken as interchangeable and therefore as referring to the same.

A3: Terms & Conditions

Post-production service

Data transaction policies:

Footage can be sent in three ways. they are Online submission(any size), courier (any size), offline/home / in-house-office visit (Max 100GB).
1. We will not be responsible for any mechanical errors on the hard disk or pen drive sent by courier.
2. In case of bulk order, the hard disk sent by courier can be deposited in the address of Subhmangalam till the end of the edit.
3. Rush/Raw Files must always be zipped and uploaded to the specified link provided by Subhmangalam.
4. Failure to send RAW data within 10 days of order placement will result in late delivery.

A4: Payment terms:

1. 60% of the full amount will be taken as advance.

2. All due payments should be cleared at the time of full-resolution file delivery/before the online link submission.

3. Advance is never refundable. In case of order cancellation also advance money will be treated as a cancellation charge. The project cannot be canceled after it has been edited.

A5: Instructions and formalities:
Subhmangalam will not be responsible for any indefinite delay in delivery due to the following reasons-
(a) After order placement, a Google form will be provided to submit all written instructions regarding song selection, concept, and editing. If a customer takes more than 10 days (late) to submit,
it may be too late to get delivery. Because in this case the schedule of the selected editor is changed due to having no information to start the job.
(b) The bill will have a code next to all the project names. If it is not there, then you must ask for it from Subhmangalam Executive whoever is available.
This code must be used correctly when filling out the Google form.
(c) If you do not have a good shot, you must first specify the instructions in the Google form according to the client's choice.
With no reference, a video link must be given. Otherwise, there will be no re-editing due to dislike after editing.

A6: Correction policy:
1. Once all the corrections are done free of cost. But if any further change is required after that, an additional charge of Rs. 500 will be levied for each correction session.
2. If any changes/corrections are required, those must be submitted by the client (written/google form) within 5 days of preview delivery.
3. If the client does not mention the song or music before editing, and demands changes, then only the audio track will be changed during the correction. If the video footage is re-arranged with new music,
it will be considered as re-editing. Then the customer has to pay for re-editing.
4. If a new RAW file/folder is added after editing, additional charges will be added according to the number of files (which have not been sent before).

A7: Delivery terms:
1. Edited files will be delivered via Google Drive link within 7 months from the day of submission of selected files, not from the day of the event.
2. A preview copy will be given first (460p), and Full Resolution will be given after correction and receiving payment.
3. If all the edits and corrections are done and the remaining money is not paid within 2 days and the file is not delivered,
then from then onwards you will have to pay a 50/- rupees per day late fee. This file will be kept for a maximum of 30 days. Then all the files will be deleted.

A8: Cinematography service:
1. Booking is from 10 am to 11:59 pm. If the event does not end by midnight, additional charges may be added.
2. After midnight, 10 percent of each team member's total dues will be added.
3. Transportation costs are charged separately. It must be paid instead of showing the ticket or car booking bill.
4. If a team member claims any extra money other than a bill, contact Subhmangalam first.
5. It is your responsibility to understand and take the file copy by paying the payment at the end of the workday. Subhmangalam will not be responsible for any damage to the file after that day.
6. All payments have to be cleared on a working day and then the file copy will be given.

A9: Copyright & Credits: Under Section 209 of the Act, IPR law, Subhmangalam can legally use its trademarks/name in the edited videos as per project involvement (Edit & CC/Vfx/Graphics). If any customer wants to hide the Subhmangalam logo or watermark from the credit list, some amount of money (which will be decided by the organization authority) will be taken as a royalty charge.

A10: Website

We employ the use of cookies. By using Subhmangalam's website you consent to the use of cookies in accordance with Subhmangalam's privacy policy.

Most modern-day interactive websites use cookies to enable us to retrieve user details for each visit. Cookies are used in some areas of our site to enable the functionality of this area and ease of use for those people visiting. Some of our affiliate/advertising partners may also use cookies.

A11: License

Unless otherwise stated, Subhmangalam and/or its licensors own the intellectual property rights for all material on Subhmangalam. All intellectual property rights are reserved. You may view and/or print pages from www.subhmangalam.in for your own personal use subject to restrictions set in these terms of service.

You must not:

Sell, rent, or sub-license material from www.subhmangalam.in
Reproduce, duplicate or copy material from www.subhmangalam.in

Redistribute content from Subhmangalam (unless content is specifically made for redistribution).

A12: User Comments

This Agreement shall begin on the date hereof.
Certain parts of this website offer the opportunity for users to post and exchange opinions, information, material, and data ('Comments') in areas of the website. Subhmangalam does not screen, edit, publish or review Comments prior to their appearance on the website and Comments do not reflect the views or opinions of Subhmangalam, its agents, or affiliates. Comments reflect the view and opinion of the person who posts such a view or opinion. To the extent permitted by applicable laws www.subhmangalam.in shall not be responsible or liable for the Comments or for any loss cost, liability, damages, or expenses caused and or suffered as a result of any use of and/or posting of and/or appearance of the Comments on this website.
Subhmangalam reserves the right to monitor all Comments and to remove any Comments that it considers in its absolute discretion to be inappropriate, offensive, or otherwise in breach of these Terms of Service.
You warrant and represent that:
1. You are entitled to post the Comments on our website and have all necessary licenses and consents to do so;
2. The Comments do not infringe any intellectual property right, including without limitation copyright, patent or trademark, or other proprietary rights of any third party;

You hereby grant to Subhmangalam a non-exclusive royalty-free license to use, reproduce, edit and authorize others to use, reproduce and edit any of your Comments in any and all forms, formats, or media.

A13: Hyperlinking to our Content

The following organizations may link to our Web site without prior written approval:
1. Government agencies;
2. Search engines;
3. News organizations;
4. Online directory distributors when they list us in the directory may link to our Web site in the same manner as they hyperlink to the Web sites of other listed businesses; and
5. Systemwide Accredited Businesses except soliciting non-profit organizations, charity shopping malls, and charity fundraising groups which may not hyperlink to our Web site.

These organizations may link to our home page, to publications or to other Web site information so long as the link: (a) is not in any way misleading; (b) does not falsely imply sponsorship, endorsement or approval of the linking party and its products or services; and (c) fits within the context of the linking party's site.
We may consider and approve in our sole discretion other link requests from the following types of organizations:

We shall have no responsibility or liability for any content appearing on your Web site. You agree to indemnify and defend us against all claims arising out of or based upon your Website. No link(s) may appear on any page on your Web site or within any context containing content or materials that may be interpreted as libelous, obscene or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.

We reserve the right at any time and in its sole discretion to request that you remove all links or any particular link to our Web site. A16: Terms & Conditions (IMPORTANT POINTS):

(1). Payment Should be made within the date mentioned: (i) Booking Advance 60% of Total Package.(**Non-Refundable), (ii) 30% of Total Package On/Before Event/Wedding Day & (iii) Rest 10% After Delivery.

(2). Payment Method: Cash, PhonePe / GPay / Bank Transfer.

(3). RAW Images are subject to copyright, cannot be used without our consent/signature/watermark, & we **expect credit while posting on any social media platforms.

(4). Travel Allowance should be provided by the client or You have to pay the necessary expenses after the event on the extra expense bill.

In the case of OUTSTATIONS, the client has to make the necessary arrangements otherwise all travel expenses will be added to the extra expense bill.

(5). Proper Accommodation (Clean Rooms with proper washroom facility & Charging facility for at least 5 people) Should be provided during the Event for the Team or pay the necessary expenses for a HOTEL ROOM on the extra expense bill.

(6). Delivery of Final Production will be done within 7 months from the day of the selection of Files (Photo, Songs & Name Credits)- **Not from the day of your Event.

(7). It's Your Duty to Choose & Select Your Songs & Photos (we are not liable for any missing pictures after printing or total song change of full video) & send your selections on time, we are not liable for your late submissions as we process first come first serve basis to maintain our delivery policy.

(8). We are not liable for any missing shots on events or rituals as a disturbance in shooting by guests through different ways.

(9). We are not liable for the difference in the quality of your post-production depending on the package you choose. (Please choose your package carefully, Don't request us to provide you the same thing in the lower packages as in the higher packages).

(10). Proper Event Timings should be provided 1 week before the Event.

(11). We Enlist every client in our portal & provide an Agreement Copy & an Online Bill, (Without which you won't allow us to shoot at any event, this is just to protect our firm name, quality of work & good relationship with our clients).

(12). If you choose creative packages & we are not allowed to shoot properly, then we are not liable for any package discounts later (After the event) for any purposes.

(13). All charges for Extra items provided on the event, should be paid on the event day on the extra expense bill.

(14). We are not liable for any loss of items in your location provided by the client.

(15). Proper Permission should be taken during the event (**Ex: During COVID time).

(16). All Final Bookings should be done through Call or WhatsApp after Advance Booking Payment.

(17). We are not liable for late service by courier.

(18). If anyone misbehaves with any of our team members & if we found inappropriate to work, we will resign from the event & we will not refund the amount.

(19). Cancellation Charges For 70% of the Total Package: (i) within 2-Months: 70% will be refunded, (ii) within 1-Month: 50% will be refunded, (iii) within 15-Days: 20% will be refunded, (iv) within 1-Week(7days): 10% will be refunded.

(20). IF FOOD IS NOT PROVIDED AT THE EVENT OR NO ONE HAS ASKED THE TEAM TO HAVE BREAKFAST / LUNCH / DINNER, THEN PAYMENT SHOULD BE MADE ON THE EXTRA EXPENSE BILL.
